Can I take the code and data with me?

You receive a deployable binary build, not readable source code — the site is yours, the code is not open source. The domain licence, the admin account and all business data (content, products, orders, enquiries) are yours: data can be exported in full at any time, Changing features or layouts (effectively custom development) is something we would scope separately.
